What is Workers’ Compensation for Home Depot?

Workers’ Compensation is defined as a set of laws to protect people injured at work with benefits in the form of monetary rewards to help avoid litigation/lawsuits. The benefits also apply to dependents of workers who are killed in work accidents.

Workers’ compensation insurance for Home Depot employees can provide you with:

  • Medical benefits, including covering medical bills
  • Lost wages (when unable to work for at least seven days)
  • Vocational rehabilitation benefits
  • Compensation for your family if your work-related injury causes death

Under Georgia state law, if an employer has three or more regular employees, including seasonal, full-time, or part-time, they must carry workers’ compensation. This includes Home Depot stores.

Do I Need an Attorney?

Yes. An attorney who specializes in workers’ compensation claims can help you navigate the workers’ compensation policies and the insurance companies. Just because your employer is required to provide workers’ compensation benefits doesn’t mean they will automatically provide you with those benefits.

Below are common scenarios injured workers run into with their employers:

  • The insurance company attempts to limit benefits owed to you
  • The employer denies “controverting” claims, looking for reasons to deny your claim
  • You’re feeling pressure to return to work too soon after your injury
  • Your employer attempts to fire you
  • You are unable to perform your job as a result of your injury
  • You have a pre-existing condition that the insurance company is attempting to use as a reason not to pay you the benefits owed

Georgia workers’ compensation lawyers such as Beth Gearhart are here to help and compassionately defend your settlement case. Beth and her team will fight on your behalf to help you receive the maximum amount of settlement benefits you deserve from your injury while working at a Home Depot store.

Workers’ Compensation Lawyer For Home Depot Employees: Frequently Asked Questions

Will Home Depot pay me if I am injured at work?

You might be compensated for your injuries depending on how the injury occurred while at work, among many other factors. Beth Gearhart and her team will fight on your behalf to get you the settlement you are owed.

What happens if I miss work as a result of my injury?

Under OCGA § 34-9-220, you are entitled to weekly wage benefits if you cannot work for at least seven days as a result of your work-related injury. In Georgia, weekly workers’ compensation benefits are calculated as two-thirds of your average weekly salary, which is calculated based upon all the wages you received (including overtime, bonuses, and any other benefits) in the 13 weeks prior to your work-related injury, subject to certain maximums.

Can I visit my private doctor if I am injured as a Home Depot employee?

You will need to visit a doctor listed on the Panel of Physicians at your Home Depot work location. The Panel of Physicians list identifies at least six doctors you can choose from to document your injury. Under Georgia law, your employer is required to have posted the Panel of Physicians and explained it to you.

If your employer has not posted the list publicly and/or never explained it to you, then you might be able to visit a private doctor of your choosing.

Additionally, at least one of the doctors must be an orthopedic surgeon, at least one must be a minority physician, and there must be four other properly qualified physicians.

Beth Gearhart and her team can help with this process.

How much is my claim worth?

The exact amount you are entitled to through the workers’ compensation depends on several factors:

  1. Your weekly income benefits
  2. Any PPD rating
  3. Medical treatment

The above factors have a direct impact on your compensation amount, therefore it’s important to seek the advice of a Georgia workers’ compensation attorney.

Can I get paid for emotional pain and suffering in workers’ compensation?

Unfortunately, workers’ compensation does not cover compensation for emotional pain and suffering, even at a big box store. Workers’ compensation does cover several items including lost wages if you missed work due to your injury and medical expenses.

Why hire a lawyer for workers’ compensation?

Most individuals have difficulty navigating workers’ compensation policies and insurance companies, especially when they are currently dealing with an injury from an incident at their job. Workers’ comp attorneys in Georgia can fight for you and your rights.
